I. INTRODUCTION

Survey Harbor OÜ (and any reference to Survey Harbor OÜ shall include Survey Harbor’s affiliates, parents and subsidiaries, collectively "The Portal" or "Service") is a global technology company operating on the basis of a PaaS model ("Portal as a Service"). The Portal recruits and manages the community of respondents who wish to take part in paid online surveys and other rewarded research programs on the one hand. On the other hand, the Portal integrates and connects to online insights exchange platforms that provide access to the ongoing market research and opinions demand database, i.e. connect community of the Portal to researchers, agencies and brands, for the accessing and sharing of consumer data. Headquartered in Tallinn, Estonia, the Portal uses various legal entities to support its global presence.

All references in this Privacy Notice to the Portal include Survey Harbor and its affiliated, parent and subsidiary companies. All references to "us" or "we" refer to Survey Harbor.

This Website Privacy Notice ("Privacy Notice") describes the types of information we collect, how we collect the information, how we use the information, how we share or disclose the information, how we store the information, and your choices regarding the use and processing of the information. This Privacy Notice describes all your interaction with the Portal from the perspective of Personal Data involvement and treatment. The Portal strives for being entirely compliant with the EU legislation regarding data protection and privacy. The information in this Privacy Notice is based on the European Union General Data Protection Regulation (2016/679) or GDPR, which provides a high standard with respect to the protection of Personal Data. However, depending on where you live, other privacy laws and regulations may apply as well. This Privacy Notice applies to users from both EEA (European Economic Area) and residing outside EEA.

II. COLLECTION AND USE OF YOUR PERSONAL INFORMATION

We define Personal Data ("Personal Data" which may also be referred to as Personally Identifiable information or "PII") as any identifiable data relating to a natural person that is directly or indirectly collected, by us or a third party.


1. Information We Collect

When using our Service, you will be prompted to provide us with personal information used to contact or identify you. We collect the following information:

  • Data of the device used to connect to the website;
  • Name;
  • Email;
  • Date of Birth;
  • Gender;
  • Country of residency and postal code;
  • Address;
  • Socio-demographic profile: employment, family and household, financial wealth, interests and consumer habits, health condition, range of owned / used goods and services, social media profile, online activity preferences and subscriptions, ethnicity, religious, political, civil opinions, views and beliefs, lingual preferences;
  • Payment details for redeeming the incentive rewards.

Some information listed in socio-demographic profile as well as payment details, depending on your country of residency may be considered to be Sensitive Personal Data, for example political opinions or religious beliefs. If we collect your Sensitive Personal Data, we will always obtain your explicit consent. You are not obliged to disclose such a data and will have the access to all the Portal features and survey offers without disclosure of such a data.

Data of the device used to connect to the website may be automatically collected and stored in log files includes the following:

  • Internet Protocol (IP) address of computers accessing the site;
  • Web page requests;
  • Referring web pages;
  • Browser used to access site;
  • Time and date of access.


2. How We Collect Information

Your Personal Data will always be collected by fair and lawful means, for specific purposes. The Portal collects and receives information from you in the following manner:

  • When you fill a registration form, respondent profile form or otherwise submit your personal information.
  • From external sources. Additionally, the information included in socio-demographic profile in the ranges mentioned above can be collected via a secured S2S (server-to-server) communication from a Portal partner. This may happen when you have not yet filled all the respondent profile information on the Portal and are routed to the one of our partners holding the survey, then asked any socio-demographic pre-screening questions to understand if you are matching the target audience of the respective survey. In this case the partner may send the data back us to use it upon the subsequent survey match attempt with the purpose to avoid repeatable pre-screening qualification flow. It may happen only when you are an existing Portal member and following the survey entry links and then filling the pre-screener profile on the destination page means your consent to such a mechanics of data transfer and collection.

We collect your Personal Data on a voluntary basis. Your information will be stored for up to 30 (thirty) days after it is no longer required to provide you the Service. Your information may be retained for longer periods for reporting or record keeping in accordance with applicable laws. Information which does not identify you personally may be stored for up to 3 (three) years.


3. How We Use Your Information

The Portal may use your information for the following purposes:

  • Providing and maintaining our Service on the whole, as well as monitoring the usage of our Service. The fulfillment of the general purposes of the Portal and provision of the Service on the whole is impossible without the access to your Personal Data.
  • Managing your account. Your Personal Data can enable access to multiple functions of our Service that are available to registered users.
  • To contact you. Survey Harbor will contact you by email or another form of electronic communication in relations to the functions, products, services, or security updates when necessary or reasonable.
  • To update you about news, general information, special offers, new services, and events.
  • Targeted advertising. Your Personal Data will be used to improve advertising efforts that are relevant to your specific interests.
  • For the performance of a contract. Your Personal Data will assist with the development, undertaking, and compliance of our partnerships with online insights exchange platforms, the cooperation underlying the mission and the purposes of the Portal.
  • Reviews and customer feedback collection. If you share a feedback or a review about your experience using our Service, it may be shared or otherwise used on the website.
  • To transfer Personal Data to any subsidiary or group company.
  • Statutory and regulatory compliance.
  • For other purposes. The Portal will use your information for data analysis to identify usage trends or determine the efficiency of our marketing campaigns when reasonable. We will use your information to evaluate and improve our Service, products, services, and marketing efforts.


4. How We Share Your Information

Survey Harbor does not sell your information and does not disclose your information, except as described in this Privacy Notice or as otherwise consented to by you. We will share your information in the following situations:

  • With your consent. We will share your information for any purpose with your explicit consent.
  • For transfers of business. Your information will be shared in the event of connection, negotiation, merger, sale of business assets, financing, or acquisition of all or a portion of our business with another company. Should such a sale or transfer occur, we will require the other party (for instance, the resulting or surviving entity in a merger, or the acquiring entity in an acquisition) to agree in writing to use, protect, and maintain the integrity, security and confidentiality of the transferred Personal Data in accordance with our Privacy Notice.
  • Sharing with affiliates. We will share your information with our affiliates. These may include our parent company or subsidiaries, partners, or companies that we control and the directors, managers, officers, employees, consultants, and agents of these companies, subject to the terms of this Privacy Notice or as otherwise disclosed to you at the time of the collection of the information or as subsequently consented to by you.


5. Third-party Sharing

Any third party we share your information with must disclose the purpose for which they intend to use your information. They must retain your information only for the duration disclosed when requesting or receiving said information. The third-party service provider must not further collect, sell, or use your personal information except as necessary to perform the specified purpose.

Your information may be shared to a third-party for reasons including:

  • Services provided by the market research companies to match Portal users to the available surveys, route users into such surveys, track their respondent session and reward accordingly based on the respondent session outcome. Identifying information and information collected by automated means may be provided for the purposes of identifying respondents for re-contact surveys or communications, fraud detection and/or prevention, database matching, data validation, data append, coding, data segmentation, and reward, incentive, and/or promotion related services in case such services are provided on the top of the Portal's incentive program.
  • Analytics information. Your information might be shared with online analytics tools in order to track and analyze website traffic.
  • Payment processing and recovery services. Your information will be used in order to process payments in the event of redeeming the reward on the Portal for your respondent activity.
  • Marketing initiatives. Your information will be used for generating and sending newsletters, email marketing efforts, advertisements, and more.
  • Services for automated advertising placements.

If you choose to provide your information during registration or otherwise, you are giving Survey Harbor permission to use, share, and store that information in a manner consistent with this Privacy Notice.

Your information may be disclosed for additional reasons, including:

  • Complying with applicable laws, regulations, or court orders.
  • Responding to claims that your use of our Service violates third-party rights.
  • When we believe that disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with suspected or actual illegal activity.

Survey Harbor will require others who acquire or provide Personal Data to us, including those engaged to provide support services, to adopt and comply with the principles in this Privacy Notice. We acknowledge our potential liability in cases of onward transfers to third parties.

We may maintain Personal Data or machine identifiable information in order to satisfy your requests and/or our business requirements.


6. Cookies

Moreover, routing you to other websites either in a separate browser tab, window, or through webview technology is the underlying foundation of the Portal business model as the surveys you are offered are normally hosted on insights exchange platforms or its clients' server. Survey Harbor is not responsible for the performance of websites operated by third parties or your interactions with them. When you leave this website, we recommend you to review the privacy practices of other websites you interact with and determine the adequacy of those practices.


IV. CHILDREN

We are committed to protecting the privacy of children. This website is not intended for minors. No information should be submitted to us by users under the age of 16, and we do not collect information from any user we have reason to believe is a child under the age of 16. If we become aware that Survey Harbor has inadvertently collected Personal Data from a child below the age where parental consent is required, Survey Harbor will delete such Personal Data from the database.


V. WHERE IS INFORMATION STORED?

All information is stored on servers and systems located in the EU, which servers are rented, owned, and/or maintained by Survey Harbor.


VI. SECURITY

Your information’s security is important to us. Survey Harbor utilizes a range of administrative, physical and technical security measures to prevent the misuse, loss, or alteration of the information you have given us. Notwithstanding the foregoing, transmissions over the Internet and/or a mobile network are not one hundred percent (100%) secure, and we do not guarantee the security of transmissions. We are not responsible for any errors by individuals in submitting Personal Data to us.


VII. YOUR RIGHTS

You have the right to review, correct, or delete your Personal Data, subject to applicable laws and regulations:

  • Right of access — you have the right to obtain confirmation and information about the processing of your Personal Data;
  • Right to rectification — you have the right to have any inaccuracies about your Personal Data corrected;
  • Right to erasure — you have the right to have your Personal Data deleted (this right is limited to data which according to law and regulation may only be processed with your consent, if you withdraw your consent for processing);
  • Right to restriction of data processing — You have the right to require that the processing of your Personal Data be restricted (during the course of any investigation into honoring your request, Survey Harbor’s access to your Personal Data will be limited);
  • Right to data portability — You have the right to have your Personal Data transferred to another party (this right is limited to data provided by you).

Upon receiving a request from an individual, we will attempt to provide the requested information within 30 (thirty) days, given the request can reasonably be addressed and responded to within this time frame. If more time is required, we will notify you within 30 (thirty) days.

In certain situations, however, we may not be able to provide access to some Personal Data. This may occur when:

  • Providing access to Personal Data would likely reveal Personal Data about a third party;
  • Disclosing the information would reveal confidential commercial information; or
  • The information has been collected for the purposes of a legal investigation.

If we deny an individual’s request for access to one's Personal Data, we will advise the individual the reason of the refusal.

Only English version of the present Privacy Notice should be recognized as an official document. Versions in all other languages are made for your readability and convenience purposes. If contradictions or distortions are found among the official text and its translations, English text should be considered to be foreground.
